Health & Safety at Work Act 2015
In light of the new Health and Safety at Work Act 2015 effective as at 4th April 2016, we have compiled a short summary of this new legislation for your information.
The motivation for the new Act is to improve New Zealand’s poor health and safety record. The key changes in the Act are as follows:
- It introduces the “reasonable practicable” concept – focusing attention on what’s reasonable for an organization to do in their Health and Safety management
- It changes the focus from the physical workplace to the conduct of work i.e. how we work and what an organisation can control
- It supports more effective worker engagement and participation in Health and Safety. In other words, it encourages everyone in the organisation to participate in Health and Safety and not just leave a policy filed in a drawer or sitting on a wall with no action being taken.
How this legislation impacts Body Corporates / Multi-Unit Bodies
Body Corporates / Multi-Unit Bodies are regarded as PCBU’s (Person Conducting a Business or Undertaking) and will be responsible for:
- Protecting the health and safety of all workers carrying out work at the premises influenced or directed by the PCBU
- Protecting the health and safety of other persons visiting the premises
- Ensure compliance with the Act through regular monitoring, reducing hazards and improvements as required.
